# Presidential Regulation 27/2026 on ride-hailing: the 8% app fee, partner status and complaints

**What does Perpres 27/2026 mean for ride-hailing drivers and couriers, which rules apply now, and where can I complain?**

Presidential Regulation (Perpres) 27/2026 on Protecting the Digital-Platform Transport Ecosystem was officially released on 8 October 2026. Drivers remain partners of the app companies under a Platform Partnership Agreement, and the app fee for passenger rides is capped at 8%, a rule already in force through a Transport Minister’s decree since 1 July 2026. Delivery fees for goods and food still await a regulation from the Minister of Communication and Digital Affairs, while partnership agreements are overseen by the Ministry of MSMEs. The full text was not yet in the official legal databases as of 14 October 2026, so details may still be added.

## What drivers should have ready

- Your driver-partner account and trip or delivery history in the app.
- A breakdown of each transaction: the fare paid by the customer, the app fee deducted and your net income.
- A copy of the Platform Partnership Agreement or the partner terms you accepted.
- Screenshots of messages, account sanctions or fee-change notices from the app company.
- The ticket number and date of your complaint to the app company’s service centre.
- Your BPJS Kesehatan and BPJS Ketenagakerjaan card or membership number, if you are registered.

## How to check your rights and complain

1. **Know which service you provide.** The rules differ for passenger rides and for goods or food delivery. The 8% app-fee cap already in force applies to passenger transport, which the Ministry of Transportation regulates. Delivery fees for goods and food will be set by the Ministry of Communication and Digital Affairs (Komdigi) and have not been issued.
2. **Work out the deduction on each trip.** Compare the app service fee with the fare the passenger paid. For passenger rides the app fee may be at most 8%. The regulation also gives drivers a right to clear information on service fares and app fees, so ask for a breakdown if it is not shown.
3. **Check your Platform Partnership Agreement.** The agreement must be clear, fair, transparent and easy to understand, and must cover rights and obligations, the fee structure, incentives, social insurance, access to transaction data, use of algorithms and the complaints process. App companies and drivers must bring it into line within six months of the provisions taking effect.
4. **Make sure you have social insurance.** According to the Ministry of Transportation, the regulation gives drivers a right to social insurance covering at least health insurance, work-accident insurance and death insurance under the relevant rules. Check whether you are registered with BPJS Kesehatan and BPJS Ketenagakerjaan, and who pays the contributions under your partnership agreement.
5. **Complain to the app company first.** App companies must run an accessible complaints centre and respond within seven days of receiving a complaint. Keep the ticket number and screenshots of the reply.
6. **Escalate to the government if unresolved.** If there is no reply within seven days or the reply breaks the rules, complain through SP4N-LAPOR! at lapor.go.id and choose the responsible agency: the Ministry of MSMEs for partnership agreements, the Ministry of Transportation for passenger fares and app fees, or Komdigi for goods and food delivery. The Ministry of Transportation also takes contacts on 151.

## The app-fee cap and complaint costs

Complaining to the app company, the Ministry of Transportation or SP4N-LAPOR! is free. For passenger rides, the app service fee an app company may deduct is capped at 8%. No cap has yet been set for goods and food delivery.

## What Perpres 27/2026 covers

On 8 October 2026, at the parliament complex, the Ministry of State Secretariat announced that the government had officially released Presidential Regulation 27 of 2026. It covers matters including electronic systems, micro businesses and partnerships, and employment social insurance, and involves the Ministry of Transportation, the Ministry of Communication and Digital Affairs and the Ministry of MSMEs.

According to the Ministry of Transportation, it covers passenger transport and goods and food delivery on digital platforms, on principles of fairness, safety, transparency and sustainability. App companies must apply fairness, transparency and compliance when setting both service fares and app fees.

The division of work: the Ministry of Transportation oversees passenger fares and the 8% app-fee cap; the Ministry of MSMEs oversees partnership agreements between drivers and app companies; Komdigi regulates the technical side of digital transactions and delivery fees for goods and food. The three agreed to set up a joint communication forum or task force.

## What has not changed: drivers remain partners

The regulation does not make drivers employees of the app companies. The Ministry of Transportation says it strengthens the partnership between drivers and app companies through the Platform Partnership Agreement. Employment rules for staff, such as the minimum wage or the religious holiday bonus (THR), therefore do not automatically apply.

What changes is the content and clarity of that partnership. The agreement must set out both parties’ rights and obligations, the fee structure, incentive schemes, social insurance, access to transaction data, the use of automated algorithmic systems (computer rules that allocate orders or impose sanctions) and the complaints process. App companies and drivers must update the agreement, fee and income information systems, transaction receipts and records for each type of service within six months of the provisions taking effect.

## Drivers’ rights and social insurance in the official statements

According to the Ministry of Transportation, drivers have the right to clear information on service fares and app fees, protection of personal data, an explanation of how automated algorithmic systems are used, and a complaints and dispute-resolution process.

Drivers also have the right to social insurance covering at least health insurance, work-accident insurance (JKK) and death insurance (JKM) under the relevant rules. We have not found in any official statement who pays the contributions or how; check your partnership agreement.

Drivers still have duties: keeping the vehicle roadworthy, servicing it regularly, using safety equipment such as a helmet and obeying traffic rules. App companies are asked to support safety, for example by monitoring vehicle condition and sending service reminders.

## Still pending: goods, food and the Road Traffic Law

Delivery fees for goods and food will be set in a regulation of the Minister of Communication and Digital Affairs. Komdigi says the calculation cannot simply copy passenger transport because of waiting time, parcel size and different service features, and that it will consult platforms and drivers. As of 14 October 2026 that decree had not been issued, so the 8% cap does not yet automatically apply to goods and food couriers.

Separately, the government has agreed to parliament’s proposal to add a Chapter XIII A to the third amendment of Law 22/2009 on Road Traffic and Transport (LLAJ), covering special rental cars and motorcycle transport of people, goods and food. The Ministry of Transportation hopes the revision will be finished in 2026 so that it can apply from 2027. Until it passes, ride-hailing is not regulated in a law.

## Things to check carefully

- Assuming the 8% app-fee cap already applies to goods and food delivery. The Komdigi rule for those services has not been issued.
- Thinking the regulation turns drivers into employees. The relationship remains a partnership.
- Going straight to a ministry without proof of a complaint to the app company. Keep the ticket number and allow up to seven days for a reply.
- Trusting copies or summaries of the regulation shared on social media before the official text appears in a government legal database.
- Not registering for social insurance on the assumption that the app company covers everything. Check your partnership agreement.
